Rodriguez’s BMW collided with a parked automobile on April 16, 2010, according to police records analyzed by the Halifax Chronicle Herald.

Rodriguez behaved suspiciously when the officer tried to use a breathalyzer on him.

He held the plastic tip of the breathalyzer at the edge of his lips and cut his air repeatedly, making it difficult for the test to be administered properly.
